These Membership Terms and Conditions (“Membership Terms”) govern the purchase, use and benefits of any BIKEFIXUP Membership Plan, including but not limited to Silver, Gold, Premium and any future membership plans offered by BIKEFIXUP.
By purchasing a Membership Plan, the Member agrees to be legally bound by these Membership Terms, the User Agreement, Privacy Policy, Terms of Service and all related BIKEFIXUP policies.
1. MEMBERSHIP ELIGIBILITY
1.1 Membership may be purchased only by individuals legally capable of entering into binding contracts under applicable law.
1.2 Membership benefits are available only for the vehicle registered against the membership unless otherwise approved by BIKEFIXUP.
1.3 Membership benefits cannot be shared, transferred, assigned, resold, exchanged or commercially exploited.
2. MEMBERSHIP VALIDITY
2.1 Membership validity shall commence from the date of successful payment.
2.2 Membership validity shall expire automatically upon completion of the selected membership period.
2.3 Unused benefits shall automatically lapse upon expiry.
2.4 No cash value shall be provided for unused benefits.
3. MEMBERSHIP FEES AND TAXATION
3.1 All Membership Plan prices displayed by BIKEFIXUP are inclusive of applicable Goods and Services Tax (GST) at the prevailing rate of 18%, unless otherwise expressly stated.
3.2 A GST-compliant tax invoice shall be generated and issued after successful payment and confirmation of membership activation.
3.3 In accordance with applicable tax laws, BIKEFIXUP may issue a provisional invoice, quotation, estimate, order summary, or payment request prior to receipt of payment. Such document shall not be treated as a final tax invoice.
3.4 The final GST Tax Invoice shall be generated only after successful receipt of payment through approved payment channels and shall be delivered electronically via registered email address, mobile application, WhatsApp, SMS link, customer portal, or any other digital mode determined by BIKEFIXUP.
3.5 Any future changes in GST rates, cess, duties, levies, or other statutory taxes imposed by Government authorities shall automatically apply to membership fees and related services without requiring amendment to these Terms.
3.6 Membership fees are strictly non-refundable, including the GST component, except where refund is mandated by applicable law.
3.7 Customers acknowledge that GST and other statutory taxes collected by BIKEFIXUP are government-imposed charges and are not retained as company revenue.
3.8 Membership fees are strictly non-refundable.
3.9 Membership fees are non-transferable.
3.10 Membership fees are non-adjustable against future services.
3.11 No refund shall be issued for:
- Change of mind
- Non-usage
- Partial usage
- Vehicle sale
- Vehicle theft
- Vehicle damage
- Vehicle total loss
- Relocation
- Account suspension
- Membership termination due to breach
4. FAIR USAGE POLICY
4.1 Membership benefits are intended solely for normal personal vehicle usage.
4.2 BIKEFIXUP reserves the right to investigate excessive, abnormal or commercial usage.
4.3 Membership may be suspended or terminated if misuse is detected.
5. FREE SERVICE CONDITIONS
5.1 Free services are preventive maintenance services only.
5.2 Free service does not include:
- Spare parts
- Consumables
- Major repairs
- Accident repairs
- Insurance claims
- Electrical repairs
- Body work
- Painting
- Denting
- Modification work
5.3 Premium Plan includes engine oil only as specifically stated.
5.4 Additional work shall be separately chargeable.
6. WASHING AND POLISHING BENEFITS
6.1 Washing and polishing benefits are strictly walk-in benefits.
6.2 Prior appointment may be required.
6.3 Unused sessions shall lapse upon membership expiry.
6.4 Sessions cannot be redeemed for cash.
7. PICKUP AND DROP BENEFITS
7.1 Premium Members may avail pickup and drop services subject to operational feasibility.
7.2 Pickup and drop are available only within operational service areas.
7.3 BIKEFIXUP reserves the right to refuse pickup and drop where:
- Safety concerns exist
- Distance exceeds operational limits
- Weather conditions prevent service
- Operational constraints arise
7.4 Pickup and drop may be limited to one service request per calendar month unless otherwise approved.
8. DISCOUNT BENEFITS
8.1 Membership discounts cannot be combined with:
- Promotional offers
- Festival offers
- Coupon codes
- Referral offers
- Corporate discounts
- Partner discounts
8.2 Maximum discount per invoice shall remain ₹200 unless otherwise announced.
9. FREEBIES AND PROMOTIONAL ITEMS
9.1 Complimentary items are subject to stock availability.
9.2 BIKEFIXUP reserves the right to substitute promotional items with equivalent alternatives.
9.3 Complimentary items carry manufacturer warranties only.
9.4 No cash alternative shall be provided.
10. APPOINTMENT REQUIREMENTS
10.1 Certain benefits require prior booking.
10.2 Members shall schedule appointments through approved channels.
10.3 Missed appointments may be counted as utilized benefits at BIKEFIXUP’s discretion.
11. MEMBERSHIP SUSPENSION OR TERMINATION
BIKEFIXUP reserves the right to suspend or terminate membership immediately if:
- Fraud is detected
- False information is provided
- Membership is transferred
- Abuse of staff occurs
- Direct mechanic arrangements are made
- Non-payment occurs
- Criminal activity is suspected
- Terms are violated
No refund shall be payable upon termination.
12. MODIFICATION OF BENEFITS
12.1 BIKEFIXUP reserves the right to modify, replace, withdraw or update membership benefits.
12.2 Such changes may be made without prior notice where necessary for operational, legal or commercial reasons.
12.3 Existing benefits already availed shall remain unaffected.
13. LIMITATION OF LIABILITY
13.1 Membership benefits are provided on an “as available” basis.
13.2 BIKEFIXUP shall not be liable for:
- Loss of membership benefits
- Missed appointments
- Service delays
- Third-party failures
- Force majeure events
13.3 The Company’s liability shall never exceed the membership fee paid.
14. GOVERNING LAW
These Membership Terms shall be governed by the laws of India.
Any disputes shall be subject to:
- Arbitration as per BIKEFIXUP User Agreement
- Exclusive jurisdiction of Faridabad, Haryana Courts
